Commercial Financing Disclosure
Apex Capital Partners is a commercial finance company, not a depository bank. Products offered through this site are commercial business financing solutions. They are not consumer loans and are not subject to consumer credit protection laws (such as the Truth in Lending Act or Regulation Z).
State-Specific Disclosures
For applicants located in California, New York, Utah, Virginia, Connecticut, and other states with commercial financing disclosure laws, a complete disclosure of financing terms — including the total amount financed, total payback, payment schedule, and estimated APR — will be provided in writing prior to acceptance of any offer.
Soft / Hard Credit Inquiries
Our initial eligibility review uses a soft credit inquiry, which does not impact your credit score. A hard credit inquiry occurs only with your written consent after you accept a written offer of financing, and is performed by the funding entity placing the advance.
Fees
Apex does not charge upfront application, processing, or origination fees. Closing costs typical to the industry (origination, underwriting, ACH setup) are deducted from funded proceeds at the time of disbursement and disclosed in your funding agreement.
UCC-1 Filings
It is standard industry practice for a UCC-1 financing statement to be filed at the time of funding. This filing does not pledge specific collateral and does not affect ownership of your business assets. It can be terminated upon full satisfaction of the financing.
Plain-English Summary
A working capital advance is not a loan. You receive an advance against your future business receivables. You repay through a fixed daily or weekly remittance, or a percentage of daily sales, until the advance is fully satisfied.
